I got child support since 2000. I never asked for a raise or modify. But he never paid health insurance and never visited once in this 8 years. But I have significantly raised income this years. And I don't know his income. Does any one know if I may request a raise of child support?
Thanks.Does any one know the standard to raise or modify a court ordered child support? You cannot request a raise in child support just based on you having more time with him. If you take it back to court, there is a good chance that (since your income has significantly increased) you will end up getting less.
If you are carrying health insurance on the child and your ex is not, then that would raise his child support. Your best bet is to get an attorney on board with you. Fill out the necessary paperwork and then have him served with the Motion to Modify (Support only). Your attorney can make him provide them with current copies of income tax returns so that the necessary paperwork can be completed and a new support amount can be en-stated.
As I said before, though, if your income has gone up significantly and his has not - you may end up getting less in support rather than more.
Good Luck!Does any one know the standard to raise or modify a court ordered child support?
Might want to try the Attorney General Office of the state you live in. If not you will have to take the other parent back to court, but it will be expensive.
By the way, it's probably none of my business, but why raise this issue after eight years?Does any one know the standard to raise or modify a court ordered child support?Yes, you will need to contact your lawyer and file for a revision. Your ex will be served with a summons to report to court and he will have the option to retain a lawyer. Unless he wants to really fight you over it, it will probably be "heard on the other side"- meaning that you two and your lawyers will sit down and come to an agreement so that the judge isn't bothered with it.
And...to the guy above me- you revisit it after 8 years because the cost of living has increased over the past 8 years and the amount of child support she is receiving hasn't!! Kids are expensive!Does any one know the standard to raise or modify a court ordered child support?
your income significantly raised over the years? you may screwing yourself by going back to get it revised, they may just lower the amount he has to pay Does any one know the standard to raise or modify a court ordered child support? You sure can take him back to court...get yourself a lawyer, and he will do it for you...if you don't have any money, look in the phone book
for your local Legal Bar...if you call them they will tell you if any Lawyers will do your case for free...or look under legal help...
There really are Lawyers that will do this...
after 8 years its time you need more income because of inflation, etc...No matter what your income is...
good luck to you!!Does any one know the standard to raise or modify a court ordered child support?
In most states, you can go back to court every 36 months.
Your child is lucky to have had a parent back out of the situation. It creates a much more stable environment for the child/young adult.
So, my standard is "What is more important, money or a stable situation for your child?"
Now I'm someonee that was a single parent and took no child support and I am also the parent that just told some in-laws to stick half a million just to get them out of mychildren'ss lives.
