610 mth. She has full custody. We both paying for health insurance. My income is 31k yr hers 25k a year.Maybe i can carry health insurance by myself. If you know something we have one week, what can I tell me lawyer to do?The time spent with child is fixed, cant be changed just the support. How can i modify this court order to lower my child support? On what grounds would you lower the child support? Do you believe that since she has full custody and is taking care of the child 24/7 that she should also pay more of the financial costs relating to your child? Do you really want her to get less money? What about your child? Should your child have less food, less rent (the roof over their head), less clothing, less school trips, less transportation, etc. because you want the mother to have less child support?
Now to answer your question, it doesn't really matter what you ask for with or without the lawyer...the judge is not going to reduce the child support if it means that the child goes without even if you are helping to provide health insurance (the mother is too). And the courts certainly won't let you pay less than the state mandated minimum. If you don't have enough money to make ends meet, I suspect the courts will suggest that you get a second job.
It took two of you to make this child...the mummy and the daddy...and it will take the two of you to raise it until the child turns 18. If the mother is doing most of the child rearing, then you will be paying a bigger share of the child support. That is just how it goes! But for the future, you may wish to remember that a condom is cheaper than 18 years of child support.
Good luck! How can i modify this court order to lower my child support?
Sounds like you aren't paying that much support. I don't see how it gets lowered, if it is consistent with the support guidelines. How can i modify this court order to lower my child support? The only way would be to try and arrange it amicably, with your ex, but if you and her hate each other, it won't work. If you can deal sanely together, then you can agree on things like your insurance idea, or shopping for the kid's school supplies or clothes and agree on how much that is worth. How can i modify this court order to lower my child support?
If you didn't want to support a child, you shouldn't have made one. Stop being a dick wad, man up and pay $610. Since she has full custody that gives you plenty of time to get a second job.How can i modify this court order to lower my child support? What is your attorney telling you to do? You are paying good money for his/her advice.
If visitation is fixed and the only negotiating point is medical insurance: since the mother is providing health insurance, you are probably paying extra for that. Have your attorney do a support calculation and exclude coverage your ex is providing and see what the number are. Thing is, you better get coverage and not let the medical coverage lapse or you will no doubt end up in court again. How can i modify this court order to lower my child support?
First, you need to know that the child support guidelines are not set in stone. They are just guidelines. You can make a case for not paying so much.
1988 Public Law Record
SEC. 103. STATE GUIDELINES FOR CHILD SUPPORT AWARD AMOUNTS.
(A)(a) GUIDELINES TO CREATE REBUTTABLE PRESUMPTION.-Section 467(b)
of the Social Security Act is amended-
(1) by inserting (1) after (b):
(2) by striking, "but need not be binding upon such judges or other officials;" and
(3) by adding at the end the following new paragraph:
(4) "There shall be a REBUTTABLE presumption, in any judicial or administrative proceeding for the award of child support, that the amount of the award which would result from the application of such guidelines is the correct amount of child support to be awarded. A written finding or specific finding on the record that the application of the guidelines would be unjust or inappropriate in a particular case, as determined under criteria established the State, shall be sufficient to rebut the presumption is that case."
You need to file a motion to modify your child support. If you are current in your support, you can do this by making an official request for a modification at the child support enforcement office under the provisions of Public Law 12.
If there are arrears, contact the Clerk of the Court and request forms for filing for a modification, Pro Se.
You will need to get a copy of the child support guidelines and worksheet from child support enforcement to determine if you have cause for a reduction. There needs to be at least a 20% difference in his payment.
NEVER pay your child support directly to the mother as it can be considered a gift and not support. Always pay threw the court.
