If someone could steer me in the correct direction. My ex and I have been split for a few years now. We have joint custody, if she decides to switch shifts and has to get daycare for our two kids am I responsible to pay? I have them more than she does, I pay her child support and I pay for health insurance. Oregon is the state of residence. Also if either party moves within 60 miles who is responsible for transportation.Child care expenses and moving after divorce?This is George.
If she switches, she can apply for you to pay a percentage of the cost, based on your incomes, but you could counter with a rebuttable presumption that since you have the children more then she does, that you should pay less. Also, time in school and daycare does not count toward her time, even in addressing who get the child tax credit under IRS rules. The IRS deduction does not go by the court orders.
As for moving, the applicable rule would be that the person that moves makes up the difference in the exchange. The cut off in most states is 50 miles for this to apply.
