If a american woman concieves in uk through a uk national & gives birth in uk, is the child uk citizen?

I have been advised by mother that child is american through mother. Im unsure of this. it also seems the mother wishes to take the child away after she has used the British health service to give birth. The child will take the mothers citizenship.



IF the father is british, and the parents not married - then the father MUST make an affidavit (or write something and get it notarised) to the effect that this is his child, and that he is an british citizen.

I would think they child would have dual citizenship. If they are born in the uk then they are a citizen of that country reguardless of the nationality of the parent



You may have been born with parents from different countries but i guarantee they would have to go through the immigration process first. You do not automatically get dual citizenship!
The child would have dual citizenship. UK and US both allow this when you have one of each parent.

Is the father British? Are the parents married at the time of the birth? Just because a child is born in the UK does not mean they have British citizenship that right was removed in the 1980's to stop abuse of the system. If you are British and the mother is American then the child is most probably a dual-citizen. It should have two passports - and use the British one to leave the UK and the American one to enter the US - and vice versa. A passport will be all the baby needs to prove it's citizenship. :-)

Both the father and the mother should be able to pass on their citizenship. Both should register the child before it's 18 as citizens of their countries. You would do this through your country's immigration departments.



The mother should register her child as a U.S. citizen before attempting to return with it to the United States.
The only way that the child would be a UK citizen is if the father was a UK citizen. American is the only country (that I know of) that grants citizenship to everyone who is born in the country. The UK does not.
