Its according to what state you live in. Some of them have adopted laws that it is based on both incomes and then done by percentage.

If you are going through CSR they do their best to keep that away from the man. Most CSR's are totally discriminatory towards men no matter what the circumstances are. Possibly. You can petition the court to review your income and expenses.
Unless something has changed since the court order, you can not ask for a change in the payments. For example:



1. If at the time of the original court order your ex was not working, and now has a job that pays $8000 more than you make, that is a substantial change and you can petition for a change in payments based upon her improved financial status.



2. If you lost your job or got demoted and are now earning less than you were at the time of the original order, you can ask for a change in payments due to your decreased financial status.



3. If at the time you were only ordered to make payments and the insurance was something you added on your own later, you can ask that the insurance premiums be included as part of your payment.



Something had to have changed before you can get the child support payments changed..



But also, you might ask for joint custody. With 50/50 custody, neither of you has to pay support. You each will have the child half of the time.



Or you might ask for full custody and have her pay child support. For example, if her new job means the kid is in daycare 10 hours a day, 5 days a week, you could use that if you could care for the child more at home. If the child is in child care for more than 60 hours a week, or if the child has to be farmed out to relatives due to her being out of town a lot, you could use that as a reason why you could get full custody. etc...
